ORDER

This criminal original petition has been filed seeking direction to the investigation officer to conduct further investigation based on the 1/4

Evidence available with the petitioner and the CCTC footage in Crime No.266/2023.

2.This petition has been filed by the petitioner seeking direction to the second respondent herein to conduct the investigation based on the CCTV footage available in the place of occurrence. Earlier application filed by the petitioner's wife has been dismissed by this Court observing that the plea has been taken by the wife of the petitioner in the absence o petitioner. In pursuance of the above said observation, this petition has been filed by the petitioner making the above said grievance. 3.The learned Additional Public Prosecutor would submit that eye witnesses is available to the occurrence, to implicate this petitioner in the murder event. According to him, no CCTV footage is available in that place of occurrence. Some persons has taken video in their mobile phone. But, his identity could not be verified or found out. Moreover, the petitioner is now absconding. Since eye witnesses are there, there is no question of directing the second respondent herein to collect evidence in favour of this petitioner. The petitioner has no right to claim the 2/4

direction to conduct the investigation in particular manner. He has to surrender before the respondent police and co-operate with them to complete the investigation process. The petitioner shall give statements with regard to the particulars of the occurrence. So that the second respondent can conduct the investigation in proper manner. The petitioner is not entitled for any relief in this petition. This petition deserves to be dismissed, of course with the above said observations and directions.
