Pleased to allow the above Appeal and consequently set aside the order of conviction and sentence imposed on the Appellant by the Hon`ble Special Judge for Trial of Prevention of Corruption Act Cases, Madurai District by means of judgment dated 20.08.2019 made in Special Case No.43 of 2011 forthwith. Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PALANI VELAYUTHAM.S, Advocate for the petitioner and of Mr.B.NAMBISELVAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to condone the absence of the petitioner on the first working day for the month of December 2023 (01.12.

2023) before the learned Special Judge for Trial of Prevention of Corruption Act Cases, Madurai District in pursuance of the order of this Court dated 27.08.2019 made in Crl.M.P(MD)No.7547 of 2019 in Crl.A(MD)No.377 of 2019. 2.The learned counsel appearing for the petitioner submitted that due to health issues the petitioner was hospitalized from 28.11.2023 to 02.12.2023. So, the petitioner was unable to comply the condition on 01.12.2023. Hence, he prayed to condone the absence of the petitioner.

3. Being satisfied with the reasons stated in the affidavit filed in support of this 2/3

petition and in the interest of justice, this petition is allowed and the petitioner shall appear before the learned Special Judge for Trial of Prevention of Corruption Act Cases, Madurai District, on the first working day of every month at 10.30 a.m., from January 2024 onwards until further orders.
