Mr.R.Suresh Kumar, Government Advocate(Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.18 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for 1/3

the offences punishable under Sections 403, 420 IPC altered into Section 403, 409, 468, 471, 420 and 120(b) IPC in Crime No.18 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that A1 is working as Senior Revenue Inspector at the Aadhi Dravidar Welfare Department in Sivagangai. A2 is the husband of A1, A3 is the relative of A1. A1 has to prepare money bills of the Sivagangai District Adhi Dravidar Welfare Department and have to submit before the Sub-Treasury office at Sivagangai. But, she collected and misappropriated that money by sending into the bank accounts of A2 to A4 including the petitioner herein. Hence, the case.

3.The learned counsel appearing for the petitioners would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail. 4.The learned Government Advocate(Crl.side) appearing for the respondent police would submit that the amount was credited to the petitioner's account from the Treasury. Hence, he objected to grant bail to the petitioner. 5.On perusal of records, it is noticed that all the accused misappropriated the amount, which was allotted to the Aadhi Dravidar Welfare Department, Sivagangai. Considering the seriousness of the offence committed by the petitioner, this Court is 2/3

not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
