O R D E R
An order dated 11.09.2023 of the Tahsildar declining to conduct a survey by citing the pendency of O.S.No.55 of 2023 and the objections of the second respondent is challenged herein.
2. At the hearing on 13.03.2025, this Court recorded that the second respondent has no objection for the survey being conducted. It was also rcorded that there are three different FMB sketches relating to the same survey number.
3. Learned Government Advocate has placed on record the online copy of the FMB sketch. On perusal thereof, it appears that Survey Nos.60/7A, 60/7B1 and 60/7B2 lie on the northern side of Survey No.60/9B3. The second respondent has filed patta transfer orders indicating that the current pattadhar of Survey No.60/7B1 is the petitioner's wife Rajeshwari and that the current pattadhar of Survey No.60/7A is the petitioner.

Therefore, the boundaries of the properties of the petitioner and the second respondent, respectively, may be measured and demarcated if the survey is extended to lands in Survey Nos.60/7A and 60/7B1.The second respondent shall file an online application and submit requisite fees for such purpose. 3/6
5. For reasons aforesaid, this writ petition is disposed of on the following directions:
(i) Within two weeks from the date of receipt of a copy of this order, the second respondent is directed to file an online application for the survey of lands in Survey Nos. 60/7A and 60/7B1.
(ii) Within three months from the date of receipt of such application, the first respondent is directed to carry out the survey of lands in Survey Nos.60/7A1, 60/7B1 and 60/9B3. Before doing so, notice should also be issued to owners of lands adjoining these three properties. No costs.
