JUDGMENT

When the matter was taken up for hearing today (11.11.2025), the learned counsel for the appellant and the learned counsel for the respondent 1/3

were present before this Court and submitted that it is a case between a landlord and tenant and that as per the decree of the trial Court, the property has been delivered and the execution proceedings have already been terminated.

2. Hence, the learned counsel appearing for the appellant seeks permission of this Court to withdraw this Second Appeal and has also made an endorsement to that effect in the case bundle.
