ORDER : The Court made the following order :- The petitioner/accused, who arrayed as accused was arrested and remanded 1/3

to judicial custody on 27.10.2023 for the offences punishable under Sections 341, 294(b), 307 and 506(ii) IPC, in Crime No. 309 of 2023, on the file of the respondent police seeks bail.

2. The case of the prosecution is that due to previous motive, the petitioner herein wrongfully restrained the defacto complainant and his son and attacked him with knife and also abused him in filthy language. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 27.10.2023 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that due to previous motive, the petitioner herein has attacked the defacto complainant and his son and caused grievous injuries and hence, he strongly opposed to grant bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioner and also the considering the fact that the injury sustained by the defacto complainant is grievous in nature, this Court is not inclined to grant bail to the petitioner.
