ORDER

Heard both sides.

2. The petitioner herein filed W.P.(MD)No.10238 of 2024. The writ petition was disposed of on 27.03.2025 in the following terms:- "3. For this limited reason, I am inclined to set aside the order of the first respondent and the matter is remitted to the second respondent to conduct an enquiry after affording an opportunity of personal hearing to the petitioner as well as the accused District Revenue Officer, against whom allegations have been made by the writ petitioner and thereafter, the second respondent shall pass final orders on the petitioner's application, within a period of twelve weeks from the date of receipt of a copy of this order."

Pursuant to the said direction, the District Collector, Madurai has passed a fresh order dated 03.11.2025 negativing the petitioner's request for taking action against the then DRO. The order passed by the District Collector may be vulnerable. But it would not constitute contempt. This is because, this Court without going into the merits of the matter had called upon the District Collector to pass an order on the petitioner's application. The petitioner wanted action to be taken against the then DRO. The Collector has taken decision that no case has been made out 2/4

for taking action against the DRO. The stand of the District Collector may or may not be sustainable. But then, the remedy is to challenge the said order dated 03.11.2025. Granting such liberty to the petitioner, the contempt petition is closed.
