Respondents Prayer : This Criminal Revision petition is filed under Section 397 and 401 of Cr.P.C., to call for records and set aside the order of conviction and sentence dated 18.01.2011 in C.A. No.92 of 2004 on the file of the learned Sessions Judge, Kanyakumari Division at Negercoil, confirmed the order of convictiion and sentence dated 30.03.2004 in C.C.No.101 of 2000 on the file of the learned Judicial Magistrate, Padmanabhapuram by allowing the above Criminal Revision petition and acquit the petitioner from all charges.

ORDER
The petitioner herein was convicted for the offence under Section 138 of the Negotiable Instruments Act in C.C.No.101 of 2000 on the file of the learned Judicial Magistrate, Padmanabhapuram. The conviction was confirmed in C.A.No.92 of 2004 on the file of the learned Sessions Judge, Kanyakumari Division at Nagercoil. Questioning the same, this Criminal Revision has been filed.
2. During the pendency of this Revision case, the parties had arrived at an amicable settlement. It appears that the defacto complainant had passed away and that compromise was arrived at between the petitioner and the legal heirs of the defacto complainant.
3. In view of the same, the Judgments passed by the Courts below stand set aside. The Criminal Revision stands allowed in terms of the compromise memo.

4. At this juncture, the learned counsel appearing for the petitioner submitted that the fourth respondent is also no more. But the learned counsel appearing for the respondents submitted that the remaining legal heirs confirmed that the matter has been settled. No costs.
