The original petitioner in this revision case filed S.T.C.No.979 of 2007, on the file of the learned Judicial Magistrate, Sathankulam to prosecute the respondent for the offence under Section 138 of Negotiable Instruments Act. The case suffered dismissal under Section 204(4) of Cr.P.C., because the correct address of the respondent could not be traced. Challenging the dismissal of the complaint, this Criminal Revision Case came to be filed.
2.During the pendency of the revision case, the complainant himself passed away. Even today the petitioner's counsel is unable to give the correct address and the current whereabouts of the respondent. I am of the view that no purpose will be served in keeping this issue alive.
