The Commissioner, Karur City Municipal Corporation, Corporation Office, Karur.
... Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent to cancel the lease stands in petitioner's name in pursuant to the proceedings in Na.Ka.No. 1468/2011/A6 dated 12.05.2017 issued by the respondent by considering petitioners representation dated 10.05.2020 and 22.11.2023. For Petitioner : Mr.D.Nallathambi For Respondent : Mr.K.Balasubramani Special Government Pleader 1/3
ORDER
Heard both sides.
2. The only request made in the writ petition is that his lease should be cancelled. Such a request is made because the petitioner does not want his liability to accumulate further. The learned Special Government Pleader appearing for the corporation would submit that the petitioner is in huge arrears. Cancellation of the lease has nothing to do with the right of the respondent to proceed against the petitioner for recovery of the arrears.
3. The respondent is directed to cancel the petition mentioned lease immediately and without any delay. Granting liberty to the respondent to take steps for recovering the arrears, the Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 18.12.2023 Index : Yes / No Internet : Yes/ No rmi To The Commissioner, Karur City Municipal Corporation, Corporation Office, Karur.
