Mr.Rms.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 61 of 2014 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/A7 who apprehends arrest at the hands of the respondent police for the offences punishable under sections 147, 148, 294(b), 323, 324, 506(ii) of I.P.C, in Crime No.61 of 2014 on the file of the respondent police, seeks anticipatory bail. 1/3

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor submitted that the petitioner is the accused in C.C.No.320 of 2014 on the file of the Judicial Magistrate, Nilakkottai, Dindigul District. In this case, the petitioner was already on bail and for non appearance before the trial Court, NBW has been issued on 28.10.2021 and now, NBW is pending and hence, the petition filed for anticipatory bail is not maintainable. Therefore, the learned Additional Public Prosecutor prays for dismissal of this petition.

3. A perusal of the petition, it is noticed that in this petition for anticipatory bail, the petitioner has not disclosed about the fact that the petitioner was already on bail and for non-appearance of the petitioner, NBW has been issued and the same is pending. Suppressing the fact, the petitioner has filed the present petition. It is unfair on the part of the petitioner. Hence, the present petition for anticipatory bail is not maintainable.
