PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the R1 to issue necessary direction to the R2 to give Police Protection to the petitioner based on the complaint of the petitioner dated 04.09.2023 made to the R1 and R2. ORDER
This petition has been filed seeking direction to the first respondent to issue necessary direction to the second respondent to give Police Protection to the petitioner based on the complaint of the petitioner dated 04.09.2023 made to the respondents 1 and 2. 2.The learned Additional Public Prosecutor would submit that the representation/complaint was enquired. Suit for partition was filed. Even though preliminary decree was passed, final decree was not applied by either of the parties. Pending the final decree process, representation has been made by the petitioner seeking police protection, which is not at all maintainable.
3.The petitioner has to workout his remedy through appropriate proceedings before the concerned civil Court. When final decree process is pending, there is no question of police protection to any one of the parties.
4.In view of the above, this criminal original petition stands disposed of.
