PRAYER :- This Criminal Miscellaneous Petition has been filed under Section 483(3) of BNSS, to cancel the bail granted to the respondent/accused No.2 in Crl.OP(MD).No.16676 of 2025 dated 26.09.2025.

ORDER : The Court made the following order :- This Criminal Miscellaneous Petition has been filed seeking to cancel the bail granted to the respondent/accused No.2 in Crl.O.P.No. 16676 of 2024 dated 26.09.2025.

2. The learned counsel for the petitioner/defacto complainant submitted that the 2nd respondent/accused filed a bail petition before the Sessions Court, and the same was dismissed on 25.09.2025. While the bail petition is still pending before the Sessions Court, the 2nd respondent simultaneously filed another bail application before this Court and had completely suppressed the bail petition pending before the Sessions Court, Madurai while filing the present bail petition before this Court. Hence, he prayed to allow this petition.

3. Heard the learned Government Advocate (Crl.Side) appearing for the 1st respondent and the learned counsel appearing for the 2nd respondent.

4. After hearing the rival submissions this Court had given its anxious consideration. It is seen from the records that the learned counsel for the 2nd respondent has filed bail application before this Court without producing the "dismissed bail order" of the trial Court. When the registry objected to entertain the petition for not filing the copy of the bail order, the Learned Counsel had mentioned before this Court. This Court permitted the petitioner to file the bail petition with a condition to produce the copy of the order before completing the process of numbering the petition and issued a slip. When the petition was taken up for numbering the learned counsel produced the order copy but the slip had lost its validity of that date. Hence the date of the slip was modified for the next date. When the bail application was heard all the formalities were completed including annexing the dismissal order of the bail Court. Thereafter, this Court had granted bail after considering the merits of the case.

5. Therefore, the ground of irregularity and filing two bail applications are rejected. Apart from the above, no other grounds were raised by the petitioner for cancelling the bail order.
