Respondent/Complainant Prayer : This Criminal Revision petition is filed under Section 397(1) and 401 of Cr.P.C., to call for the records of the Judgment of the learned District and Sessions Judge, Fast Track Court, Pattukottai, dated 26.04.2011 in C.A.No.67 of 2011 confirming the Judgment and sentence passed by the learned Judicial Magistrate, Pattukottai, dated 27.10.2009 in C.C.No.1793 of 2002 and thereby allow this appeal.

ORDER

The petitioner was found guilty of the offence under Section 409 r/w 34(13 counts) of I.P.C. and sentenced to undergo three years Rigorous Imprisonment. Fine was also imposed on him. This is a concurrent finding and sentence given by the Court below. Challenging the same, this Criminal Revision has been filed.

2. When the matter was taken up for hearing, the petitioner's counsel submitted that he would not question the finding of guilt and he would be satisfied, if leniency is shown in the matter of punishment. He pointed out that the petitioner must be aged about more than 82 years. He also spent a few days https://hcservices.ecourts.gov.in/hcservices/

in prison.

3. Therefore, taking note of the advanced age of the petitioner, this Court even while sustaining the conviction imposed on the petitioner, reduces the sentence of imprisonment imposed on the petitioner to the period already undergone.

4. With this modification, the Criminal Revision stands partly allowed. No costs.
