Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle the arrears of Dearness Allowance for the periods from January 2018 to March 2018 (3 months), July 2018 to August 2018 (2 months), January 2019 to April 2019 (4 months) and July 2019 September 2019 for total period of 12 months which were not settled till the date of retirement on 31.05.2022 along with belated payment interest at the rate of 6% p.a. from the date of retirement till the date of payment. 1/4

ORDER

The present writ petition has been filed by a Selection Grade Checking Inspector who attained superannuation on 31.05.2022.

2. According to the learned counsel appearing for the writ petitioner, Dearness Allowance for a period of 12 months had remained unpaid and the same should be disbursed with interest. Hence, the petitioner has sent a representation on 06.11.2023. Since there is no response, the present writ petition has been filed.

3. Considering the above said facts, the 2nd respondent herein is directed to confer the eligible benefits upon the writ petitioner with 6% interest from the due date till the date of realization of the amount within a period of twelve (12) weeks from the date of receipt of copy of this order.

4. With the above said observations, this Writ Petition stands disposed of. No costs.
