Respondent Petition filed under Sections 397 read with 401 Cr.P.C, to call for the records relating to the order dated 04.10.2011 made in Cr.M.P.No.1883 of 2011 on the file of the Judicial Magistrate No.VI, Trichy and set aside the same as illegal and entrust the custody of the car to the petitioner and allow the above revision petition as prayed for.

ORDER

According to the petitioner, a case has been registered against the petitioner for an offence under Section 4(1) (a) of the Tamil Nadu Prohibition Act, 1937 alleging that the petitioner has transported 22 beer bottles in the vehicle bearing Regn. No.PY 01 BJ 6300 and the said vehicle has also been seized. Subsequently, the petitioner has filed a petition seeking return of the vehicle. The trial Court dismissed the said application. Challenging the said dismissal order, the present Criminal Revision Case has been filed.

registered against the petitioner ended in acquittal and no further confiscation proceedings have been initiated against the petitioner.

3.Considering the fact that the petitioner is acquitted from the criminal case and the vehicle is also under the custody of the petitioner, nothing survives for adjudication in this criminal revision case. Accordingly, the Criminal Revision Case is closed.
