O R D E R
This Writ Petition is filed in the nature of Writ of Mandamus, directing the fourth respondent to provide adequate police protection to facilitate the general public and devotees to stay in the Chathiram and to provide Annathanam at Chokkampatti Jamin Annachathiram, during the festival of Arulmighu Coutralanathar Swamy Thirukovil, Coutralam, Tenkasi District from 18.12.2023 to 23.12.2023, by considering the petitioner's representation dated 01.12.2023, within the time stipulated by this Court.
2. Eventhough there is some sort of title issue between the petitioner and the third respondent herein, the second respondent has permitted the petitioner for conducting Annathanam in the Arulmighu 2/6
Coutralanathar Swamy Thirukovil from 18.12.2023 to 27.12.2023. Now objection is made by the third respondent over the permission granted by the second respondent to the petitioner.
3. Learned counsel for the petitioner, when the matter was heard for the first time, submitted that the Hindu Religious and Charitable Endowment has taken over the management and they permitted the petitioner to conduct Annathanam.
4. The issue with regard to the title over the properties and the management of the Choultry, is not the subject matter of this case. The petitioner wants to perform Annathanam in the relevant time. For that limited purpose only, they sought permission. Since permission is granted by the second respondent, but objected by the third respondent, this petition came to be filed. On that account the third respondent was directed to appear before this Court.
5. Today(15.12.2023), the third respondent official is present before this Court and stated that against the order passed by Co-ordinate Bench of this Court in W.P.(MD)No.24361 of 2023, they are going to file 3/6
a Writ Appeal. With regard to conducting Annathanam in the Arulmighu Coutralanathar Swamy Thirukovil, they are not having any objection.
6. Only for the limited purpose of performing Annathanam, permission was granted by the second respondent, that must be complied by the petitioner. It is made clear that the above said permission will not give the petitioner, any title over the temple / property and management, as the case may be. The petitioner shall not take any advantage of this order in future. This order will apply only for the present time, as mentioned in the petition and as permitted by the second respondent herein.
