ORDER

This petition has been filed to quash the FIR in Crime No.106 of 2025, dated 13.09.2025, pending on the file of the 2nd respondent Police, registered for the offences punishable under Sections 191(2), 296(b), 351(2) of BNS and Sections 3(1)(r), 3(1)(s), 3(1)(w)(ii) and 3(1)(zc) of SC/ST (PoA) Act, 1989.

The allegation in the impugned FIR is that the petitioners had prevented the second respondent and others from entering into the temple on account of their caste; that petitioners 3 and 4 had behaved indecently by removing their pant zip and talking in an abusive manner with the women, who had accompanied the second respondent to the temple and thus committed the aforesaid offences.

3. Since the points raised by the learned counsel for the petitioners are factual in nature, this Court is not inclined to quash the FIR in Crime No.106 of 2025. However, the first respondent shall conduct the investigation in a fair manner and file a final report before the concerned trial Court as expeditiously as possible and in accordance with law.
