This Civil Revision Petition has been filed against the order dated 25.01.2011 made in I.A.No.675 of 2010 in O.S.No.327 of 2005 on the file of the District Munsif Court, Melur. 2.The suit in O.S.No.327 of 2005 is pending before the District Munsif Court, Melur, and the same is in the concluding stage. The Interlocutory Application in I.A.No.675 of 2010 was filed to re-open the evidence of defendants and the same was dismissed. As against the same, the petitioner is before this Court.
3. Heard the learned counsel for the petitioner and the learned counsel for the respondent.
4. The learned counsel for the petitioner submits that the Interlocutory Application was filed to re-open the evidence of the defendants and the same was dismissed by the trial court. Though the learned counsel has raised many grounds in the Civil Revision Petition, the learned counsel seeks permission only to mark the judgment dated 26.09.2008 as an exhibit before the Trial Court. would submit that no prejudice will be caused by mere marking of the judgment before the Trial Court.
5. The learned counsel for the respondent has also conceded only to mark the judgment before the trial court.
6. In view of the submissions made on either side, this Civil Revision Petition is partly allowed to the extent that the petitioner is permitted only to mark the judgment dated 26.09.2008 before the trial court. No costs. Consequently, connected miscellaneous petition is closed.
