ORDER

This Criminal Original Petition is filed to pass an order of direction directing the Respondents not to harass the Petitioner under the guise of enquiry and illegally prevent the Petitioner from doing fishing using the above said Mechanized fishing boat.

2. Learned Additional Public Prosecutor submitted that on the basis of the partnership issue between the petitioner and the third respondent herein, this petition has been filed. He further submitted that in pursuance of the partnership agreement, a boat was purchased in the name of this petitioner. Trouble has arisen between them in usage of the boat. The counter party has given a complaint stating that this petitioner appeared to have stolen the fishing materials from the boat. Enquiry was conducted in C.S.R.No.4 of 2023 and the same was closed on 04.04.2023. The petitioner has also given a complaint against the third respondent, as if he has stolen the boat, taking advantage of the certificate standing in his name.

3. In view of the above submission, let the complaint be closed by advising the parties to work out remedy through civil proceedings. With this direction, this Criminal Original Petition is disposed of. 18.12.2023 NCC :
