Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the 1st respondent to instruct the 2nd respondent not to harass the petitioner under the guise of enquiry and not to obtain any signatures form the petitioners without issuing a proper summons based on the petitioner's representation dated 27.09.2025.

ORDER

The petitioner seeks for a direction to the 1st respondent to instruct the 2nd respondent not to harass the petitioner under the guise of enquiry and not to obtain signature from the petitioner without issuing a proper summons based on the petitioner's representation dated 27.09.2025.

2. The learned Additional Public Prosecutor, on instructions, would submit that the respondents are not harassing the petitioner; that there are two cases pending against the petitioner and he was summoned in connection with the said cases only for an enquiry.

3. In view of the above submission, it is needless to say that the respondents Police shall not harass the petitioner in the guise of enquiry. However, if the petitioner's presence is required for enquiry, they may issue summons in accordance with law.

4. With the above direction, this Criminal Original Petition is disposed of.
