O R D E R

The petitioner asserts that Patta No.361 in respect of the land in Survey No.213 was issued in the name of the petitioner's father earlier. Subsequently, it is stated that the said patta was mutated in the name of the fifth respondent herein. After filing an appeal before the Revenue Divisional Officer, the present writ petition has been filed.

2. Learned Additional Government Pleader accepts notice on behalf of respondents 1 to 4. On the basis of written instructions, he submits that the petitioner has failed to submit any registered documents in proof of his rights in respect of the relevant property. Without prejudice, he submits that the appeal would be considered and disposed of on merits within four months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the fifth respondent.

3. In view of the nature of relief claimed and the above submissions of learned Additional Government Pleader, it is not necessary to issue notice to the private respondent in this writ petition. Instead, the writ petition is disposed of by directing the third respondent to consider and dispose of the petitioner's appeal on merits after providing a reasonable opportunity to all parties thereto. A speaking order shall be issued within four months from the date of receipt of a copy of this order. No costs.
