Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, directing the 1st to 3rd Respondents to consider and dispose of the Petitioner's representations dated 22.07.2025 by taking appropriate action on the unlawful interference and irregularities committed by the 4th and 5th Respondents in respect of the Petitioners property comprised in Survey No.59/3, New Survey No.159/33, measuring to the extent of 675 sq. ft situated at Koodakovil Village, Kallikudi Taluk, Madurai District, within a time frame as may be fixed by this Court. ORDER
Heard both sides.
2. The case of the petitioner is that the local revenue authorities are interfering with his possession and enjoyment of the petition mentioned property.
3. The learned Additional Government Pleader on instructions states that originally, there was a proposal to lay road across the petition mentioned survey 2/4
number and that is why, some preliminary works were sought to be carried out by the respondents 4 & 5. In view of the objection raised by the villagers, the said proposal has been given up and an alternative route is proposed to be established. It is specifically submitted that as on date, the petitioner has no cause of action to maintain the writ petition. The said submission is recorded.
4. It is however directed that if in future, the authorities intend to target the petition mentioned property, the petitioner will be put on notice before doing so. The contentions of both sides are left open. The writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
