This writ petition has been filed claiming the service benefits of the petitioner's husband along with the Provident Fund and Gratuity together with interest at the rate of 18% per annum.
2. The case of the third respondent is that the third respondent / Society is running under loss and it is even difficult to pay the salary to its employees. The claim of the petitioner is with regard to the service benefits of the deceased husband, who died on 05.09.2023. The provision of the Tamil Nadu Pension Rules, 1978, also applies to the Cooperative Societies, which describes the time-line for the disbursal of the service benefits and also the terminal benefits of the deceased employee.
3. In such view of the matter, there shall be a direction to the first respondent herein to disburse the amount of Rs.19,59,330/- (Rupees Nineteen Lakhs Fifty Nine Thousand Three Hundred and Thirty only) together with statutory interest as per the Tamil Nadu Pension Rules, 2/4
1978, to the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent shall also be entitled to seek reimbursement of the amount paid to the petitioner from the third respondent, as and when the financial condition of the third respondent becomes positive.
4. With the above observation, the writ petition stands disposed of. No costs.
