PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents herein to consider petitioner's representation dated 17/09/2025 and pass appropriate orders to 1/5

restore the patta issued to the petitioner's wife in S.No.327/41 by his proceedings 1661/2007 dated 16/03/2007 by the 4th respondent an extent of 0.40.5 Hectre land and pass appropriate orders within the time stipulated by their court.

ORDER

An assignment patta had been issued to the petitioner's wife Meenakshi vide proceedings dated 23.01.2008. Subsequently, by proceedings dated 02.07.2012 of the District Collector, it was decided that such assignment patta be cancelled because the relevant lands are classified as forest lands. The present writ petition was filed after submitting a representation dated 17.09.2025 to the Chief Secretary.

2.Learned Special Government Pleader accepts notice on behalf of all the respondents. He submits that reconsideration of the decision of the District Collector may only be done by the Commissioner of Land Administration. 2/5

3.In view of the above submissions of learned Special Government Pleader, the Commissioner of Land Administration is suo motu impleaded as the 7th respondent in this writ petition. This order shall be issued after making the correction in the writ petition.

4.In these circumstances, without making any observations on the merits, this writ petition is disposed of on the following terms:- a)The petitioner is permitted to submit a representation to the Commissioner of Land Administration within two weeks from the date of receipt of a copy of this order; and b)Upon receipt thereof, the Commissioner of Land Administration is directed to consider and dispose of such representation within four months from the date of receipt thereof after providing a reasonable opportunity to the petitioner. No costs.
