ORDER

This Writ Petition has been filed for a Mandamus, directing the respondents to conduct proper enquiry in C.S.R.No.425 of 2025, dated 12.07.2025 on the file of the second respondent and consequently, directing the respondents to take appropriate action on the petitioner's complaint, dated 11.07.2025.

2. The learned Additional Public Prosecutor would submit that the petitioner/wife also appeared for enquiry and stated that she would live with her husband after he returns from abroad and therefore, the enquiry on the petitioner's complaint was closed.

3. The learned counsel for the petitioner, however, would submit that no enquiry was conducted; and that the complaint was closed only because the husband of the petitioner had agreed to live with the petitioner. 2/4

4. In view of the aforesaid statement, this Court is of the view that the respondents have not registered the complaint as no cognizable offence is made out on the complaint given by the petitioner. Whatever be the reason for the closure of the said complaint, the remedy open to the petitioner is to approach the learned Magistrate. The respondents shall communicate the closure of the complaint to the petitioner forthwith.
