..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd Respondent to remove lock in TATA INSTRA vehicle No. TN-96-H-3506 and consequently direct the 2nd Respondent to issue a fitness certificate for the same vehicle after following proper procedure as per law based on the petitioner's representation dated 10.09.2025 within a stipulated time that may be fixed by this Court.

ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus directing the 2nd respondent to remove the lock placed on the petitioner's TATA Intra vehicle bearing Registration No. TN-96-H-3506, and consequently to issue a fitness certificate for the said vehicle, after following due procedure, based on the petitioner's representation dated 10.09.2025, within a time frame to be fixed by this Court.
2. When the matter was taken up for hearing today, the learned Additional Government Pleader appearing for the respondents produced a written communication dated 09.10.2025 from the 2nd respondent, wherein it has been stated as follows:
"However, since the vehicle owner is only seeking a Fitness Certificate and not a transfer of ownership, and as the vehicle is already released, this office is of the view that there is no bar to grant the Fitness Certificate (FC) for the said vehicle, provided a suitable undertaking is obtained from the vehicle owner reaffirming that the vehicle will not be transferred until the final orders of the original case, or if the Hon'ble High Court issues a specific order in the present writ petition directing the issuance of the FC."

In view of the above, the petitioner shall furnish the undertaking as sought for, and upon such undertaking being submitted, the 2nd respondent shall permit the inspection of the vehicle for the purpose of issuance of the Fitness Certificate. The entire exercise shall be completed within one week from the date of submission of the undertaking.
