ORDER

The petitioner seeks a Writ of Mandamus directing the respondents to de-freeze his bank account bearing current Account No.510909010023135, by considering his representation dated 20.09.2025.

It is the case of the petitioner that he is running a Xerox shop; that all of sudden, the first respondent, at the instance of the second respondent had frozen his account by invoking section 106 of the BNSS; that the suspected amount in the account, even according to the bank is Rs.205/- and that in view of the freezing of the entire account, the petitioner is unable to operate his account and carry on with his business activities.

3. The learned counsel for the first respondent would fairly submit that though the disputed amount in the account is only Rs.205/- they had frozen the account, at the instigation of the second respondent. 2/5

4. Since the communication issued by the second respondent to the first respondent clearly states that the disputed amount is only Rs.205/-, notice to the second respondent is dispensed with.

5. It is seen from the communication sent by the second respondent to the first respondent that a sum of Rs.205/- credited to the account of the petitioner the disputed amount. Admittedly, there is no other transaction in the petitioner's account, which raises suspicion. Hence, this Court is of the view that the action of the second respondent in directing the debit freeze of the entire account cannot be sustained. Therefore, the respondents shall permit the operation of the account by marking a lien in respect of the disputed amount of Rs.205/-.

6. With the above directions, this Writ Petition is disposed of. No Costs.
