ORDER

This petition has been filed complaining that the wife of the petitioner aged about 27 years and his son and daughter aged 5 years and 3 years respectively are missing on and from 15.09.2025.

2. In this connection, the petitioner had lodged a complaint before the second respondent police station on 17.09.2025 in which FIR in Crime No.68 of 2025 had been registered under the caption ''woman missing'' and ''boy and girl missing''. The petitioner also impleaded the third respondent and stated that he had induced two minor children and his wife to move away from the marital house.

3. Today, the matter had been listed on being mentioned by the learned Additional Public Prosecutor, who stated that the wife of the petitioner along with two children have been secured. 2/5

4. We enquired the wife of the petitioner. She stated that she had taken a conscious decision to move away from the marital house along with the children. She admitted that she was in relationship with the third respondent. The mother in law of the petiitoner is also present today. The petitioner is also present. The wife of the petitioner is not willing to go with her husband.

5. As on today, she is not under illegal custody and has been produced before us. The consensus arrived at is that the wife of the petitioner, along with her two children would go with her mother. In view of the same, this petition is closed. (C.V.K., J) (R.V., J) 16.10.2025 CM 3/5
