Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the respondents 1 and 2 not to harass the petitioner and her family members under the guise of enquiry on the fake complaint of the 4th respondent without due process of law.

ORDER

The petitioner seeks a direction to the respondents 1 and 2 not to harass the petitioner and her family members under the guise of enquiry on the complaint of the 4th respondent.

2. The learned Additional Public Prosecutor, on instructions, would submit that the respondents are not harassing the petitioner; that an enquiry is pending on the complaint given by the 4th respondent, who is the wife of the petitioner; and that the enquiry would be completed within a period of one week.

3. The learned counsel for the petitioner would submit that the petitioner is willing to participate in the enquiry and is being harassed by the respondents on the repeated complaints of the fourth respondent; and that the petitioner has filed a petition under Section 9 of Hindu Marriage Act, for restitution of conjugal rights and the same is pending.

4. In view of the above said submissions, there shall be a direction to the respondents to complete the enquiry within a period of two weeks from the date of receipt of a copy of this order. Thereafter, the respondents shall communicate the result of the enquiry to the petitioner and the fourth respondent.

5. With the above direction, this Criminal Original Petition stands disposed of.
