PRAYER: Sub Application is filed under 151 of CPC, 1908, to reopen the contempt petition(MD) No.5358 of 2025, which was closed on 12.09.2025, for hearing and enabling the contemnor to comply with the order passed by this Court in WP(MD) No.1512 of 2010, dated 14.02.2017.

O R D E R

This sub Application is filed by the petitioner in WP(MD) No.1512 of 2010/ a retired employee of the Tamil Nadu State Transport Corporation, to reopen the contempt petition(MD) No.2358 of 2025 filed by him. This petitioner has, in fact filed the said writ petition before this Court, seeking retirement benefits. This Court, by its order, dated 14.02.2017 has allowed that writ petition, directing the respondents to pay the retirement benefits to the petitioner within a period of twelve weeks from the date of receipt of a copy of that order. However, the retirement benefits have not been settled to him and therefore, he has moved a contempt petition in Cont P(MD) No.2358 of 2025 before this Court.

When that contempt petition was taken up for hearing, a representation was made as if the entire amount due to this petitioner as directed by this Court in WP(MD) No.1512 of 2010, dated 14.02.2017 has been settled to the petitioner. Recording the submissions made on behalf of the respondent Corporation, this Court, by its order dated 12.09.2025, has closed the above contempt petition.

petitioner has filed this sub application to reopen the contempt petition that the order of this Court in WP(MD) No.1512 of 2010, dated 14.02.2017 has not been fully complied with. The entire retirement benefits due to this petitioner were not yet settled. 2.When the sub application is taken up for hearing, the learned Standing counsel appearing for the respondent Corporation submits that there was an error in the calculation and that has also been verified. Now they have found that a sum of Rs.1,26,121/- towards pension arrears was omitted to be settled to the petitioner and that amount was settled to him on 16.10.2025. 3.Considering the manner, in which the respondents have reported before this Court in the earlier occasion that too in the contempt proceedings, this Court is inclined to entertain this sub application. Accordingly, this Sub Application is ordered. The contempt petition(MD) No.2358 of 2025 is reopened. 12.12.2025 vrn 3/5
