PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents No.2 to cancel the sub division made in survey No.194/2B in Vembar Village, Vilathikulam Taluk, Thoothukudi District and issue patta in favour of the petitioner in the light of Decree and Judgement in OS No.27 of 2010 on the file of the District Munsif Court, Vilathikulam by considering the petitioner's representation dated 17.09.2025 within a time a period stipulated by this Court.

By relying on a sale deed dated 28.07.2009 and the dismissal of O.S.No.27 of 2010, the petitioner had applied for cancellation of the subdivision made in survey No.194/2B. The present Writ Petition relates thereto.

2. Learned Additional Government Pleader accepts notice on behalf of respondents 1 to 4. He submits that the matter is pending before the Revenue Divisional Officer and that orders would be issued on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and the private 2/5

respondents herein.

3. In view of the above submissions of learned Additional Government Pleader, it is not necessary to issue notice to the private respondent in this Writ Petition. Instead, this Writ Petition is disposed of by directing the second respondent to dispose of the petitioner's appeal on merits after providing a reasonable opportunity to the petitioner and the private respondents herein.
