Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a writ of Certiorarified Mandamus, to call for the records relating to the impugned orders passed by the 4th respondent in C.No.F11 P.R.No.69/2006, dated 14.02.2011, the 2nd respondent in C.No.A4/4504/ SM77/2011, dated 08.08.2011 and the 1st respondent in RC.No.045765/87/AP.II(3)/2013, dated 03.11.2016, and quash the same as illegal and further direct the 4th respondent to provide due promotion to petitioner as per the service records along with monetary benefits.
ORDER : This civil miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.N.SATHEESH KUMAR, Additional Government Pleader for the petitioners and of Mr.P.GANAPATHI SUBRAMANIAN, Advocate on behalf of the Respondent, the Court made the following order:- (Order of the Court was made by R.SURESH KUMAR, J.) This petition is filed to condone the delay of 514 days in filing the W.A. [MD]SR.No.92809 of 2023.
2.Heard both sides.
3.Though the learned Additional Government Pleader appearing for the 2/4
petitioners would submit that, the entire machinery of the petitioners had engaged in making pre-arrangements for the examination for the recruitment, the said reason is not appealing to this Court, since for making such pre-arrangements, no department can take such a huge time of more than 500 days. However, since the merits of the main issue raised in the writ appeal has to be decided, we feel that this petition, if at all to be allowed, is to be allowed on terms. 4.Accordingly, this Civil Miscellaneous Petition is allowed on condition that the petitioners shall pay a sum of Rs.5000/- [Rupees Five Thousand only] as cost to the respondent and the said cost shall be paid to the respondent through the learned Counsel for the respondent.
