Today, when the matter is taken up for hearing, the learned counsel for the petitioner sought permission of this Court to withdraw this Writ Petition with liberty to file a civil suit and he has also made an endorsement to that effect.

2. Recording the same, this Writ Petition stands dismissed as withdrawn with liberty to the petitioner to file a civil suit. If such suit is filed, the time spent in the Writ Petition shall stand excluded while reckoning the period of limitation. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
