Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to forbear the 1st respondent from registering any document in respect of the land in Survey No.404, situated 1/4
at Palkulam Village and Group, Kalaiyarkovil Taluk, Sivagangai District, pending disposal of the appeal preferred by the petitioner before the 3rd respondent.
For Petitioner : Mr.C.Prithviraj For Respondents : Mr.D.Gandhiraj Special Government Pleader for R1 to R3 : Mr.S.Rajasekar for M/s.Roy & Roy Associates for R7 & R8
ORDER
Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for R1 to R3 and the learned counsel for R7 & R8.
2. The case of the writ petitioner is that the petition mentioned property belongs to him and that due to error that took place during UDR, the revenue record now reflects the names of the private respondents. The petitioner is said to have moved the third respondent seeking correction of the UDR error. The petitioner's apprehension is that in the meanwhile, the document in respect of the petition mentioned property may be registered by the first respondent. 2/4
3. Strictly speaking, the writ petitioner has to move the jurisdictional civil Court and obtain an injunction order. Be that as it may, since the issue is pending before the third respondent and posted for enquiry on 17.10.2025, I direct the third respondent to dispose of the matter on merits and in accordance with law within a period of four weeks from 07.10.2025. The first respondent will not entertain any document from R4 to R8 for a period of four weeks from today. The writ petitioner's right will abide by the outcome of the order to be passed by the third respondent. It is open to the writ petitioner to move the jurisdictional civil Court and obtain injunction order in his favour. I clarify that merely because I have given a restraint order for a brief period by giving breathing time to the petitioner, that does not mean that this Court has endorsed the claim of the writ petitioner. The contentions of both the parties are left open. It is for the third respondent as well as the jurisdictional Court Court to exercise their discretion in the manner known to law.
4. The writ petition is disposed of accordingly. No costs.
