PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to transfer the enquiry of the complaint dated 13.8.2023 from the 2nd Respondent into some other competent Investigation Agency.

ORDER
This petition has been filed to transfer the enquiry of the complaint dated 13.8.2023 from the second respondent into some other competent Investigation Agency.
2. The learned Additional Public Prosecutor would submit that on the basis of the complaint given by the petitioner dated 13.08.2023, enquiry was conducted. During the course of enquiry, the third respondent appeared before the Enquiry Officer and gave an undertaking that he will pay the entire amount on or before 30.04.2023. On that basis, it was closed. Now, there is non-compliance of the undertaking by the third respondent.
3.In view of the submission made by the learned Additional Public Prosecutor, the Inspector of Police, Karivalamvanthanullur Police Station, Sankarankovil, is directed to re-open the complaint given by the petitioner dated 13.8.2023 and complete the same within a week from the date of re-open the complaint. Depending upon the out-come of the enquiry, further action may be taken by the Superintendent of Police, Sankarankovil.

4. With the above direction, this Criminal Original Petition is disposed of.
