Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the first respondent to survey the land in Survey No.188/5LB2 (old survey number 188/5B) situated in Ammapettai Village, Kumbakonam Taluk, Tanjore District and consequently, direct the second respondent to give police protection on the day of surveying the land of the petitioner, within the time stipulated by this Court.

O R D E R

By relying on a sale deed dated 19.10.2001 and patta No.1276, the petitioner had applied online for the conduct of a survey. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner submits that there is no rival title claim, but that owners of neighbouring lands are impeding the conduct of a survey.

3. Learned Special Government Pleader accepts notice on behalf of the first respondent and learned Government Advocate (Crl.Side) accepts notice on behalf of the second respondent. Learned Special Government Pleader submits that the petitioner's application would be acted upon after issuing notice to owners of all relevant adjacent lands.

3. The petitioner has placed on record both title and revenue records in his name. Consequently, a case is made out to consider the petitioner's request for a survey. Accordingly, this Writ Petition is disposed of by directing the first respondent to initiate action on the 2/4

petitioner's application and take all necessary steps in relation thereto within three (3) months from the date of receipt of a copy of this order after issuing notice to owners of relevant adjacent lands. If necessary, the revenue officials may take the assistance of the jurisdictional police. No costs.
