ORDER
The petitioner seeks to quash the final report in C.C.No.984 of 2025 on the file of the learned Judicial Magistrate No.II, Thoothukudi, which was filed for the offences under Section 289 and 125(b) of BNS, 2023.
2. The allegation in the final report is that the petitioner was working as a Project Manager in the Company, where the defacto complainant's husband was working; that during the course of his employment, the defacto complainant's husband fell down and sustained injuries; and that the petitioner had failed to provide adequate safety measures and thus committed the aforesaid offences.
3. The petitioner and the respondents 2 and 3 have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 22nd September 2025 and the scanned copy of the compromise memo reads as follows: 2/7

4. The petitioner, namely, Aranganathan (Aadhaar No.3790 8103 5042), and the respondents 2 and 3, namely, Devaselvam (Aadhaar No.8084 1319 0143) and Murugan (Aadhaar No.6514 3159 2088) are present before this Court in person. They are identified by Mr.P.Murugan, Special Sub Inspector of 5/7
Police, Thermal Nagar Police Station, Thoothukudi District. All the parties confirmed the compromise arrived at between them.

In view of the same, considering the nature of the offences and the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in C.C.No.984 of 2025 on the file of the learned Judicial Magistrate No.II, Thoothukudi is quashed and the Criminal Original Petition stands allowed.
