ORDER
The petitioner seeks a direction to the respondents herein not to interfere with the lawful activities of the petitioner's recreation club, in the name of Thamarai Manamahil Mandram, Athoor, by considering his representation dated 30.08.2025.
2.It is the case of the petitioner that they are a registered society and have started the recreation club for the purpose of promoting various sports, including Kabadi, Carrom, Chess, Tennis, Basketball, Badminton, Volley ball etc.; that the respondent police are conducting surprise checks and constantly harassing the petitioner by summoning the President and Secretary without any basis and hence, the petitioner's right to run the recreation club is infringed.
3.The learned Additional Public Prosecutor appearing for the 2/4
respondents would submit that the respondents have neither harassed the petitioner in any manner nor visited the premises. 4.It is needless to say that there cannot be harassment in any form by the respondents caused to the petitioner or any other person as long as they are carrying on any lawful activity. However, the petitioner cannot object to surprise checks. If the respondents require the appearance of the Secretary or the President for the purpose of any enquiry, they may issue summons. Further, if the respondents are of the view that the petitioner has violated any terms or conditions of the licence / permit or do not have a proper license, it is open to them to take appropriate action in accordance with law.
5.With the above observations, this Writ Petition is disposed of. No costs.
