Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondent.

2. It is seen that without issuing Form - II, Form - III has been straightaway issued to the petitioner.

3. In this view of the matter, the impugned Form - III notice is set aside. The respondent is at liberty to initiate 2/4

proceedings for evicting the petitioner in accordance with law. Accordingly, the Writ Petition is allowed. No costs. Consequently, connected miscellaneous petitions are closed.
