ORDER

This Criminal Original Petition is filed to direct the first respondent and his police officials that not to interfere into the civil dispute with regard to the properties in Survey Nos.828/4 (435.6 sq.ft) and 827/3 (2613.6 sq.ft) situating in Vembanur Village, Agastheeswaram Taluk, Kanyakumari and not to harass the petitioner and his family members in the guise of the enquiry based on the 2nd respondent's complaint.

2. The learned Additional Public Prosecutor would submit that the dispute arose between the vendor and the purchaser. On the basis of the complaint given by the second respondent herein, enquiry was undertaken. During the course of enquiry, both the parties appeared and gave an undertaking that they will resolve the issue through appropriate proceedings. Hence, the petition was closed. Further, no complaint is pending as on date, against the petitioner.

3. Recording the submission made by the learned Additional Public Prosecutor that no complaint is pending as on date against the petitioner, this matter has become infructuous. Hence, this petition is dismissed as infructuous.
