PRAYER :- For Bail in Crime No.165/2023 on the file of the Respondent Police. 1/4

ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 02.12.2023 for the alleged offences punishable under Sections 147, 364(A), 365, 324, 506(ii) of IPC in Crime No.165 of 2023, on the file of the respondent police, seeks bail.

2. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that earlier the petitioner was granted interim anticipatory bail for some period to take care of his father and he has been regularly taking care of them. Further the petitioner was directed to surrender before the concerned jurisdiction police within 30 days which was not complied with the the petitioner was thereafter arrested and remanded to judicial custody, hence he seeks bail.

3. The learned Additional Public Prosecutor would submit that though the petitioner was granted interim anticipatory bail he did not comply with the conditions imposed by this Court and he also did not take care of his parents even for a single day and he did not surrender before the Court. Further he absconded and went to Mumbai and later the petitioner was identified by the victim at police Station 2/4

and he was secured by the respondent police. He would further submit that there are so many previous cases pending against the petitioner.

4. Taking into consideration the facts and circumstances of the case and also taking into consideration the submission made by the learned Additional Public Prosecutor and also taking into consideration the attitude of the petitioner, this Court is not inclined to grant bail to the petitioner.

5. Hence the petition stands dismissed.
