Heard both sides.
2. The petitioner wants to put up a construction. He apprehends that a tamarind tree in the vicinity will cause damage to his foundation. He therefore wants the Tamarind tree to be felled. The Sub Collector, Kulithalai informed the Court that the branches alone can be cut and that the tree cannot be cut.
3. These are matters in which the writ Court cannot interfere. This writ petition stands dismissed. The branches overhanging the petitioner's property can very well be cut and removed. It shall not be objected to by other persons. No costs. Consequently, connected miscellaneous petition is closed. 15.10.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No PMU 3/5
