O R D E R

The present contempt petition is filed alleging disobedience of the order, dated 22.09.2023, passed in W.P.(MD)No.8543 of 2021.

2. The said writ petition was filed for issuance of writ of Mandamus to direct the respondents 1 to 3 to direct the 4th respondent to provide the signals to the petitioner's cable TV network by considering the writ petitioner's representation, dated 03.04.2021.

3. While hearing the writ petitioner, the Learned Counsel who appeared for the 1st respondent therein submitted that the petitioner was already granted 2/6

another signal. Hence, the petitioner cannot be granted one more signal. The Leaned Counsel who appeared for the respondents 2 and 3 therein also submitted the same facts. Recording their submissions, this Court had held that nothing survives for adjudication and closed the writ petition.

4. The present contempt petition is filed alleging disobedience of the above order. On perusing the affidavit filed along with the contempt petition, it is seen that the petitioner is alleging that the submission of the contemnors is false. The petitioner was already granted another signal is false and hence, the petitioner has filed the present contempt petition.

5. After hearing the submissions, this Court is of the considered opinion that there is no direction to the respondents therein to comply with any directions. This Court has only recorded the submissions and closed the writ petition. Hence, the contempt petition would not lie. If the respondents therein had made false submissions, it is open to the writ petitioner to file a review application, but 3/6

contempt will not lie. Hence, the contempt petition is dismissed. No costs. Consequently, connected sub application is closed. Index : Yes / No 26.04.2024 Internet : Yes Tmg 4/6
