PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the second respondent to conduct enquiry based on the petitioner's representation, dated 04.12.2023 and proceed in accordance with law. For Petitioner : Mr.A.Banumathy For R1 & R4 : Mr.R.M.Anbunithi, Additional Public Prosecutor.

O R D E R

This writ petition is filed seeking a direction to direct the second respondent to conduct enquiry based on the petitioner's representation, dated 04.12.2023 and proceed in accordance with law.

2. The learned counsel for the petitioner would submit that, the petitioner is the Secretary of Karaikudi Sarvodhaya Sangam at Head Office, 2-2/87, Devakottai Road, Karaikudi, Sivagangai District. The said Sangham is run by the Central Government Institution of Kathar Gramma Kaithozil Anaiyam. There are several branches established by the Central Government throughout the State. The fifth respondent was the Administer of Thirupuvanam Kadhi Pavan Branch and the sixth respondent was the Administer of Sivagangai Kaivanna Virpanai Branch. Due to some illegal activities of the respondents 5 and 6, the 2/5

management suspended them on 02.09.2023. The same was also published in 'Thinathanthi' News paper on the same day itself. However, the respondents 5 and 6 refused to hand over the keys of concerned branch. Hence, on 04.12.2023, he made a compliant to the respondents 1 to 4 with regard to the misappropriation made by the private respondents. However, till date, no action was taken on the complaint given by him. Hence, present petition has been filed by the petitioner.

3. The learned Additional Public Prosecutor for the respondents 1 to 4 would submit that on the complaint given by the petitioner, enquiry was conducted. During the course of enquiry, the petitioner was advised to work out his remedy before proper Authority. Based on that, the said complaint was closed.

4. In the complaint, it is stated that get the keys, which are in the possession of the private respondents must be handed over to the petitioner. Hence, it was rightly closed by the third respondent herein. Let the petitioner work out his remedy with regard to the handing over of keys before the proper Authority.

5.With the above direction, this Writ Petition stands disposed of. No costs.
