ORDER

This Civil Revision Petition is filed to set aside the order dated 15.11.2023 passed in I.A.No.1 of 2023 in O.S.No.58 of 2017 on the file of the Principal District Munsif Court, Pudukottai, by allowing this Civil Revision Petition.

2. The grievance of the petitioner is that a document was sought to be produced by the respondent herein before the trial Court and that was also marked as Ex.B6. He would submit that it is a xerox copy of the unregistered sale agreement dated 31.01.2013, entered into between the plaintiff and defendant. But without complying the formalities, the said document has been marked.

3. It appears that without complying the formalities, the above said document has been produced, accepted and also marked before the trial Court.

4. For complying the statutory provisions, as set out in Section 65 of Indian Evidence Act, the matter is remanded back to the learned 2/4

Principal District Munsif, Pudukottai. The Principal District Munsif, Pudukottai, is directed to comply the statutory provisions before marking the sixth document, in respect of other documents, no substantial or valid ground is raised by the petitioner.

4. With the above direction, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
