Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records of the fifth respondent pertaining to the impugned notice dated 22.09.2025 and Quash the same and consequently direct the first respondent to reclassify the land in S.No.11/1, Kanakkur Village, Avudaiyarkovil Taluk, Pudukkottai District as Government Poramboke instead of Kanmoi and then to grant Natham Patta to the petitioner by considering the petitioner's representation dated 03.03.2025, within a time stipulated by this Court.

ORDER

Heard both sides.

2.The respondents have issued the impugned Form - 3 notice, calling upon the petitioner to vacate from the petition mentioned survey number. As 2/5

per the revenue record, Survey No.11/1 has been classified only as "water body". Therefore, the question of interfering with the impugned Form - 3 notice does not arise at all.

3.The petitioner has come forward to file an undertaking affidavit both before this Court as well as the authority concerned stating that he will vacate from the premises in question within a period of six months. If such an affidavit is filed, the order impugned in this writ petition will be put on hold and kept abeyance for six months from today. The authorities are obliged to enforce the impugned order on the expiry of the aforesaid period. 4.This Writ Petition is dismissed with the aforesaid direction. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
