Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the 6th respondent to issue an Adaiyolai agreement with the 167 agricultural members and direct them to allow the 167 agricultural members to do agriculture business and further to receive the 1/4th of pattern from the harvested paddy on the base of the petitioners representation dated 09.06.2025 within a stipulated period of time fixed by this Court.

O R D E R
[Order of the Court was made by DR.G.JAYACHANDRAN, J.] A vast extent of land owned by the Arulmigu Kutralanathar Swamy Thirukovil - sixth respondent was leased out to the fifth respondent - Society. For default in paying the lease amount, the respondent - Temple has taken action for recovery of the lease amount as well as possession of the leased out property. Ultimately, through execution proceedings, the land has been recovered on 28.05.2025 pursuant to the Court directions. While so, under the guise of public interest litigation, one of the members of the fifth respondent - Society has filed this writ petition seeking a writ of mandamus directing the Assistant Commissioner of the said Temple to issue adaiyolai agreement to 167 agricultural members and to permit them to do agricultural activities.

Mr.S.Manohar, learned counsel, who takes notice for the sixth respondent - Temple, submits that this writ petition, under the guise of public interest litigation, is filed by abusing the process of law. The petitioner, who is one of the members of the fifth respondent - Society, has no locus to file a public interest litigation to expose his personal right. However, the fifth respondent - Society, in which the petitioner herein is a member, has defaulted in paying the lease amount and therefore, the leased out property has been recovered by the Temple after following due process of law. While so, the petitioner, as a member of the fifth respondent - Society, has no independent right to re-agitate the cause after the fifth respondent - Society had lost it's possession over the property on termination of the lease.
3. In view of the above facts and circumstances of the case, we find that this public interest litigation is misconceived and also filed by suppressing the facts. Hence, we are not inclined to entertain this writ petition.
4. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 17.02.2026 NCC :
