PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 1 to 3 to take necessary steps to survey and demarcate the petitioner's property and fix the Survey Stone in Survey No.406/13 to the total extent of 1 Ares extend of 985 Sq.ft situated at Viruveedu Village, Nilakottai Taluk, Dindigul District based on the petitioner's application dated 05.05.2025 by considering petitioner's representation dated 25.09.2025 within a stipulated time in accordance with law. 1/4

ORDER

By relying on sale deed dated 26.10.2023(document No.5120 of 2023) and patta No.3504 standing in the name of the petitioner, the petitioner had applied for a survey of land in S.No.406/13. The present writ petition relates thereto.

2.Learned counsel for the petitioner submits that there is no rival title claim, but the owners of adjacent lands, namely, Singam and Lakmanan have raised objections.

3.Learned Special Government Pleader accepts notice for all the respondents. He submits that notice would be issued to the petitioner and the objectors and such objections would be considered before a decision is taken. 4.The petitioner has placed on record both title and revenue records relating to S.No.406/13. The affidavit in support of the writ petition refers to 2/4

objections by Singam and Lakmanan. Therefore, it is necessary that the respondents issue notice and consider the objections of the said individuals. If it transpires that there is a dispute relating to title, the survey should not be conducted, whereas, a dispute relating to boundaries may be decided by the respondents.

5.Subject to the above observations, this writ petition is disposed of by directing the respondents to initiate action on the petitioner's application by conducting an inquiry and considering the objections, if any, by relevant adjacent land owners. The entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs. 14.10.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
