The petitioner applied online for the survey of land in Survey No.285/8B, Poolangal Village. The present writ petition relates thereto.

2. Learned Government Advocate points out that the patta in respect of the above-mentioned survey number stands in the name of the husband of the fifth respondent. He also points out that the petitioner has initiated proceedings before the Revenue Divisional Officer for cancellation thereof. In these circumstances, he submits that survey cannot be undertaken on application by the petitioner. 2/5

3. As submitted by learned Government Advocate, the patta stands in the name of Sheikh Mohammed, who is the husband of the fifth respondent. The statement that proceedings are pending for cancellation of such patta is admitted by all the parties. Therefore, until conclusion of such proceedings, petitioner's request for survey cannot be acted upon. By leaving it open to the petitioner to re-apply for a survey if he were to succeed in proceedings before the Revenue Divisional Officer, this writ petition is disposed of. No costs.
